The case takes a new turn… The request by the police by e-mail to heads of schools in Toulouse to tell them the number of absent students, without the approval of the rectorate, during the Eid al-Fitr holiday had already created outrage. From now on, this polemic creates a reaction. The association Muslim Rights Action (ADM) filed a complaint against X on Friday for “discrimination”, AFP learned from its lawyers on Monday. “These actions have the effect of stigmatizing children of the Muslim faith”, argued to AFP Me Vincent Brengarth, one of the three lawyers of the association for the defense of the rights of Muslim people.

The complaint, which AFP was able to consult, is also filed for “infringements of human rights resulting from computer files or processing”. Action Droits des Musulmans thus hopes to shed light “on the information that was actually collected and on the end use that was to be made of it”, but also to establish possible “individual responsibilities”, indicated Me Brengarth.

“A restoration of the red line”

The Ministry of the Interior had admitted to having requested an “assessment of the rate of absenteeism observed during Eid al-Fitr” but denied any “recording”. A source familiar with the matter had told AFP that it was a “clumsiness”, which did not involve “personal data”.

For his part, Me Brengarth believes that “absolutely nothing” proves that there was no use of personal data.

“Justice has a key role to play so that there is a red line restoration” on the collection of data linked to religious affiliation, he assured.
