San Salvador. A transitory regulation so that natural and legal persons, municipalities and government agencies have 90 days to settle their debts with ANDA, has been approved by legislators.

This is a Cancellation of Moratorium Interest and Surcharges for Failure to Pay Debts Arising from the Drinking Water and Sewer Service Provided by the National Administration of Aqueducts and Sewers (ANDA).

They also apply to users who have been applied surcharges for non-compliance due to extemporaneous payments, after their invoice expires and the default interest applied to an unsatisfied debt, due to a delay of more than 61 days in payment.

This time, the decree establishes that up to a maximum of 12 consecutive monthly installments will be granted, upon payment of a percentage as a premium, to those who request a term to cancel their debt.

The legislators explained that people or institutions that want to adhere to the regulations, and that have pre-existing payment plans, may request their termination and access a new one.

This benefit contemplates special treatment for people whose homes were usurped by gang members, but who have already been recovered, within the framework of the Territorial Control plan.

According to an Executive agreement of 2009, in case of extemporaneous payment, the surcharges will be the following: users with residential type service and that their consumption does not exceed 20 m3, will pay a surcharge of $1.14; if their monthly consumption is greater than 20 m3, they will pay a surcharge of 10%.

Users whose service is not residential, regardless of their monthly consumption, will pay a surcharge of 10% on the billed amount, without such surcharge being less than $5.00.

Users who only receive sanitary sewer service will pay a surcharge of $1.14. and, after 60 days of being in arrears, a default interest equivalent to the active average rate established by the Central Reserve Bank of El Salvador.
