Now the case has a richer facet. “Trouble at the Sperl family, Hochstrasse 143. A neighbor feels disturbed by keeping chickens. The chickens are registered with the BH and everything is legal. But the rooster crows so loudly that working in the law firm is almost impossible,” says an email that Wladyka, as the managing councilor responsible for construction, monument preservation, surveying, wastewater disposal and sewer construction, and public lighting, sent to the media.

“So far, no one has ever complained,” says the 77-year-old chicken owner in an interview noe.ORF.at. Lawyer Patrick Skalitzky sees it a little differently when asked by NÖN: “We sought to talk to the couple over a long period of time in order to find a solution and also invited them for coffee. Unfortunately, there was no reaction – except that the rooster flew over to us once.” Therefore, we were forced to deliver the legal letter.

The chicken keeper emphasized opposite noe.ORF.atthat it was never intended to cause such a stir. They are trying to find a peaceful solution and are ready to hand over the tap. A solution that the lawyers would be happy with.

Lawyer sees bias

Things are completely different when it comes to Gabriele Wladyka’s role. The last word hasn’t been said yet, Skalitzky noted: He was “almost speechless” because Wladyka had “presented us with a power of attorney from the family, citing her role as managing local councilor and building officer, whereupon she is now keeping chickens in her own area of ​​responsibility wanted to have checked and could not find any violation. This is a clear case of bias.”

In addition, she “posted our letter – as we believe, deliberately with our name – on Facebook, which constitutes a publication of letters that is prohibited under copyright law.” Not to mention the damage to reputation. “Apparently Ms. Wladyka didn’t quite make the transition from a citizens’ initiative to a public official.” As such, her behavior is at least “extremely strange,” Skalitzky states.

Mayor Andrea Kö, ÖVP, is currently on vacation: “I’m very surprised by all of this. I haven’t heard any complaints from anyone yet.” She will deal with the matter as soon as she returns.
