Where Park Geun-hye was imprisoned in 2017
As the High-ranking Public Officials Crime Investigation Office (Corruption Investigation Office), which is investigating the 12/3 martial law incident, has issued an arrest warrant for President Yoon Seok-yeol, attention is focused on the location of President Yoon’s investigation and detention.
According to the legal community on the 31st, if President Yoon is arrested, the Corruption Investigation Office plans to immediately conduct an investigation into the suspect on suspicion of being the leader of the rebellion at the Gwacheon Government Complex Corruption Investigation Office building. The Corruption Investigation Office is also considering creating a special investigation room inside the government building. When investigating former President Park Geun-hye in 2017 and former President Lee Myung-bak in 2018, the Seoul Central District Prosecutors’ Office established a special investigation facility equipped with resting facilities such as beds and sofas as a courtesy to the former presidents.
After the investigation, President Yoon is expected to be detained at the Seoul Detention Center in Uiwang, Gyeonggi Province. It is highly likely that President Yoon will use solitary confinement as a courtesy to the incumbent president. Former President Park, who was imprisoned at the Seoul Detention Center in March 2017, also used a 12.01㎡ (approximately 3.63 pyeong) solitary cell as a courtesy to the former president. It was a remodeled room used by 6 or 7 people. Former President Lee, who was imprisoned at the Seoul Eastern Detention Center, also spent time in solitary confinement of 13.07 m2 (approximately 3.96 pyeong).
According to the Criminal Procedure Act, an arrested suspect must request an arrest warrant or be released within 48 hours from the time of arrest. If the Corruption Investigation Office requests an arrest warrant, President Yoon will be held at the Seoul Detention Center and then moved to the court to be examined for the warrant.
Former Presidents Park and Lee, who were former presidents at the time of their imprisonment, were not able to receive security from the time they were imprisoned. However, if President Yoon’s side claims to be the incumbent president and requests security, controversy may arise. An official from the Ministry of Justice said, “There are no separate regulations related to security for the sitting president, so we are currently reviewing them.”
