Apple is allowed to resell watches in the USA despite patent disputes

In a patent dispute between Apple and the medical technology company Masimo, a US court has suspended a ban on the sale of certain Apple Watches. An appeals court in Washington decided on Wednesday at the company’s request in an expedited procedure that the company can initially sell the Apple Watch Series 9 and Apple Watch Ultra 2 models in the USA again.

Masimo accuses Apple of violating patents with functions of these electronic watches that measure oxygen levels in the blood. The two companies have already brought legal proceedings against each other because of this. Most recently, the US trade authority International Trade Commission (ITC) imposed an import ban on the two controversial watch models, which came into force on Tuesday with the approval of the government.

The smartwatch business brings Apple around $17 billion a year. The company appealed the ban on its devices after the White House previously refused to lift the measure. The ITC found in October that Apple had infringed two of Masimo’s health technology patents with a blood oxygen sensor in its watches. According to industry experts, the appeal process could take around a year until a final decision is made.

Apple had already stopped selling its Series 9 and Ultra 2 watches on its online store and in US retail stores. Online sales stopped on December 21st, and the last day to buy a new watch at an Apple physical store was Christmas Eve.

Apple has developed a software update for the Apple Watch that is intended to mitigate the problem. The company has submitted the design of this update to the US Customs Service and said on Tuesday that the government will decide on January 12 whether to approve or reject the changes.
