Delhi: Supreme Court has warned the Center on the appointment of judges. The collegium has written to the government that the Center is bound to accept the repeated recommendations. The Lok Sabha Speaker also reiterated the vice-president’s criticism of the court as the clash between the judiciary and the government escalated.

The collegium had forwarded the recommendation for the appointment of judges to various high courts to the Center the other day. In this unusual step, the Center recommended for the appointment of lawyer Nagendra Ramachandra Naik as a Karnataka High Court judge for the third time. The collegium reminds that the Center is bound to accept the recommendation made by them.

The collegium points to the judgment of the nine-member Constitution Bench in the Judges case of 1993. This is stated in the letter sent to the Union Law Ministry along with the recommendation. In November, the Center had returned the recommendation to appoint lawyers Arvind Kumar Babu and KA Sanjitha as judges to the Kerala High Court. The Center also earlier returned the names to the Allahabad and Kolkata High Courts. The Collegium also expresses its dissatisfaction with this.

The AG has informed the Supreme Court that a decision will be made soon on the recommendation of 44 High Court judges, but the order has not yet come out. Meanwhile, Lok Sabha Speaker Om Birla said that courts should respect the power of legislatures and abandon judicial activism. After taking office, the Vice President has been taking a public stand against the judiciary. Later, this criticism of the speaker is also an indication of the general political position of the government.
