ARD and ZDF are taking action against the TV broadcaster Bild for taking over broadcast material on the day of the federal election. The respective public broadcasters announced this to the German Press Agency on Thursday, independently of one another. In addition to ARD, ZDF also claims that it is drawing conclusions from the unauthorized takeover of parts of the ZDF election programs in the linear offer and on the broadcaster’s website on election Sunday. “With reference to the copyright law, the broadcaster claims injunctive relief and damages.” It is a legal warning letter. A spokesman for the TV broadcaster Bild informed the dpa that the legal proceedings of ARD and ZDF were being examined. At the beginning of the week, the spokesman had already announced this: “The Bundestag election was a historical moment. As part of our current election reporting, we quoted the widely differing forecasts live with clear references to the source and adopted selected sequences from the” Berliner Runde “and classified them for our viewers.”
The Bild spokesman had also promised: “If the takeover by Bild should result in claims from ARD and ZDF, we will be happy to settle them.”
The spokesman added that it was then assumed, however, that ARD and ZDF would assert ancillary copyrights against large US Internet platforms with the same consistency. The TV channel Bild belongs to the tabloid brand of the same name owned by the Axel Springer media group. The free-to-air TV program started in August.
