The elected president, Bernardo Arévalo, went to the office of Judge Fredy Orellana with the objective of requesting access to the file of the “Semilla” case, which keeps the political party suspended. However, his request was denied, which has led his legal team to consider another appeal before the Constitutional Court (CC).

Arévalo, who personally arrived at the office, expressed his frustration and said that the refusal “impedes his right to defense,” indicating that on 33 occasions they have been denied access to the file at the Public Ministry (MP) and on 15 occasions in court. .

Juan Gerardo Guerrero, lawyer and deputy elected by the Movimiento Semilla party, offered statements regarding the situation, and explained that Judge Fredy Orellana must resolve a pending appeal this Tuesday, December 12, as established by the highest Court.

Guerrero stated that the judge’s failure to comply with this deadline would be a violation of the CC’s orders.

“Yes, we currently have an armed strategy where we have presented legal actions in this court, even the most important is an unconstitutionality in a specific case that today (Tuesday, December 12) Judge Freddy Orellana has to resolve, and if he does not resolve (this same Tuesday the 12th), is failing to comply with what the Constitutional Court ordered, which gave it the deadlines established in the Amparo Law,” Guerrero told reporters.

Guerrero anticipates an unfavorable resolution of the unconstitutionality by Judge Orellana, but highlights that this would open the possibility of appealing again to the CC.

“We can go to the Constitutional Court to declare through a Constitutional appeal, in a specific case, the non-applicability of article 82 of the Law Against Organized Crime, which is what Judge Freddy Orellana and the prosecutor are using. Finally, Guerrero explained that, according to the procedural deadlines, he considers that a new appeal would have to be resolved in less time.

“The processing of an unconstitutionality in a specific case is relatively quick, and the appeal of unconstitutionality in a specific case is even more rapid. If we are presenting said appeal to the CCC on Monday of the other week or Tuesday of the following week (between December 18 and 19), practically by the end of the year we would have a resolution from the Constitutional Court,” he pointed out.

On November 29, the CC also declared the complaint presented by Arévalo upheld and ordered Judge Orellana to issue a new resolution on the suspension of the party’s legal personality.
