(ANSA) – TRIESTE, JULY 17 – Eight months after ASUGI’s denial, the Court’s intervention therefore requires a new verification of Martina’s conditions, which have worsened in the meantime.
The Court of Trieste intervened again, after the case of ‘Anna’, against ASUGI. The health company “denied access to medically assisted voluntary death to Martina Oppelli because it believed that she was not being kept alive by life-sustaining treatments and also subsequently believed that it did not need to carry out new checks – claims the lawyer Filomena Gallo, national secretary of Luca Coscioni, defender and coordinator of the study and defense team – Martina Oppelli needs to take a massive dose of drugs every day to be able to alleviate, even a little, her suffering which is intolerable. She uses the ‘cough machine’ due to the presence of bronchial secretions that compromise her breathing. She depends entirely on others, without whose assistance she could not carry out any vital activity and function”, specifies the lawyer.
The lawyer also emphasizes that in the appeal presented it was highlighted that in the case of ‘Anna’ ASUGI, after the conviction of the Court, had identified “in the continuous assistance of third parties the requirement of life support, while for Martina Oppelli it denied this interpretation: similar situations but diametrically opposed decisions”.
