Baghdad / Obelisk Event: A group of Tuk Tuk drivers attacked a traffic detachment and injured its members within the Al-Obeidi area in Baghdad.

In recent years, the phenomenon of assaulting the traffic police has been repeated in Iraq, which increases fears of the expansion of the phenomenon and its impact on the security situation and social stability.

The employee, Hassan al-Karbalai, commented on the incident and said, “Assaulting a traffic man is an assault on the state and is considered a violation of the law.”

The citizen, Abu Baqir al-Darraji, held the government responsible for importing the rickshaw and making chaos in the street, pointing out that what happened with the traffic today is the best evidence and the next is very bad.

Activist Abu Al-Hassan Al-Mawla considered that unless the law was imposed and an end to the repeated attacks on the prestige of the state by the statesmen themselves, there would be no reforms..and this is one of the recurring scenes in every period.

And last April, a video clip documented the incident of overtaking and assaulting a woman and her brother by beating a traffic man in Baghdad with a “block” and tearing up the officer’s notebook.

However, the phenomenon of people attacking security and policemen is illegal and its recurrence impedes the process of enforcing and applying the law, which is one of the most important functions of security and policemen.

Lawyer Amir Al-Daa’mi says that Articles 229 and 230 penalties stipulate the punishment of the attacker against the employee or assigned to a public service with imprisonment from 2 to 3 years, adding that the incident of a woman assaulting a traffic officer, if it passes unnoticed, then they agree to the law of peace.

Social researcher Hamid Qasim believes that poverty and economic inequality may lead to attacks on symbols of law in a country such as Iraq, considering that this results in dissatisfaction and resentment in society, which leads to an increase in cases of violence and attacks.
Earlier, the legal expert, Ali Al-Tamimi, detailed the cases of assaulting traffic policemen by beating and insulting them, as well as the legal penalties.

The weakness of the judicial and security system in underdeveloped countries means that there is insufficient deterrence for those involved. Where there is weak law enforcement and ineffective enforcement of penalties, this may encourage people to commit crimes without fear of consequences.
Al-Tamimi said that this crime is considered witnessed, allowing the members of the detachment to arrest the perpetrator directly without a judicial order.

A well-known crime is defined as the one whose perpetrator was found at the scene of the accident with the availability of the material and moral elements and the result.. It is investigated in felonies, misdemeanours, and infractions according to Articles 1 and 102 of the Code of Criminal Procedure, whereby the accused can be arrested directly according to these articles without the need for a judicial order.

And Al-Tamimi went on: Article 229 of the Penal Code applies to the act of the accused who insulted the security detachment, which is assaulting an employee during duty, and its penalty reaches two years in prison, adding that the Penal Code intensified the punishment in Article 230 and brought it to prison in the event of injury or harm.
