The man who in May 2021 killed two educators and three children at a daycare center in Saudades, in the west of Santa Catarina, was sentenced this Thursday (10) by the Jury Court of the Pinhalzinho district to a sentence of 329 years and 4 months in a closed regime. The sentencing council was made up of six women and one man.

Fabiano Kipper Mai, who was 18 years old at the time, has been in custody since the date of the massacre and has chosen to remain silent during the interrogation phase.

On the morning of May 4, 2021, the man entered the Escola Municipal Infantil Pró-Infância Aquarela using a dagger (a kind of sword) that he had bought online. He would have tried to kill himself after the attack and was arrested.

During the attack, two daycare workers – teacher Keli Adriane Aniecevski, 30, and education agent Mirla Amanda Renner Costa, 20 – died, in addition to three children under the age of two. A fourth child was critically injured but survived.

He was accused by the Public Prosecutor’s Office of five triple qualified homicides for base reasons, cruel means and use of resources that made it difficult for the victims to defend themselves; 13 double-qualified attempted homicides for base and somewhat cruel motives; and an attempted homicide qualified by base motive, cruel means and use of resources that made it difficult for the victims to defend themselves.

The trial, which began on Wednesday morning (9), was presided over by Judge Caio Lemgruber Taborda, from the Single Court of the Pinhalzinho district. On Wednesday, three victims, three prosecution witnesses and three defense witnesses were heard.

The central debate on the first day of the trial focused on the divergence between the possible diagnosis of the defendant’s mental illness, presented by the technical assistants of the defense and the prosecution. The names of the two psychiatrists were withheld at the request of the Court of Justice of Santa Catarina, for security reasons.

The defense claims that the defendant suffers from paranoid schizophrenia, which would make him unable to understand the seriousness of the acts he was committing.

According to the technical assistant of the defense, the accused demonstrates typical characteristics of the disease. Among them, the fact that he did not recognize himself as sick, since, at first, he would have refused to take the measurement prescribed by the doctors.

Another point made by the psychiatrist responsible for technical assistance is that the defendant has a distorted understanding of reality. According to the defense, he was the victim of bullying at school and, despite the fact being confirmed by his family, it did not have the intensity with which he perceived it.

The prosecution states that the defendant suffers from mild mental deficiency and personality disorder, mental illnesses that would not characterize him as unimputable.

The conclusion is based on two facts: the first, that the defendant would have planned the action in detail, for months. The second concerns an alleged articulation by the defendant to change his statement. This is because he would have reported the crime in detail to the police chief and later went on to claim that he has no memory of what happened.

Thus, the prosecution alleges that “there was method and intention in everything”, highlighted the technical assistant of the prosecution.

The Public Prosecutor’s Office also included the accused’s search history on the internet among the evidence that the attack was planned: there were searches on bomb making, accused of attacks on schools, purchase of firearms and content that indicated hatred for children and women.
