Barroso voted this Thursday (20th), after Gilmar Mendes, Dias Toffoli, Edson Fachin and Cármen Lúcia, who followed the understanding of the case’s rapporteur, Alexandre de Moraes. Now, there are 6 votes to 0 in favor of the defendants becoming defendants.
The trial of 100 of the 1,390 people denounced by the Attorney General’s Office (PGR) began at dawn on Tuesday (18), in a virtual plenary.
The first vote was for Moraes, at 00:00. He was also the only one who submitted the written vote.
The judgment is made in the virtual plenary of the STF. The other ministers, André Mendonça, Nunes Marques, Rosa Weber and Luiz Fux have until April 24 to vote. The magistrates analyze two actions that focus on the “executors” of the coup demonstration, that is, those who have been vandalizing the buildings of the Three Powers.
Currently, 294 people are arrested as a result of the coup acts of January 8. Among them, 86 women and 208 men. The day after the invasion, the Federal Police arrested 2,151 people. Of these, 745 were released after identification.

The case’s rapporteur voted to make the defendants defendants, justifying that they associated themselves “through a stable and permanent structure set up in front of the Brazilian Army Headquarters based in the country’s capital, to the criminal desires of the other co-authors, in order to abruptly modify the current regime and the rule of law, encouraging ‘the Armed Forces to take power’ and the population, to subvert the political and social order, also generating animosities between the Armed Forces and republican institutions”.
According to Moraes, “conducts and demonstrations that have the clear purpose of controlling or even annihilating the strength of critical thinking, indispensable to the democratic regime, are unconstitutional”.
