“Because of you I knocked my Tesla”

The tires are gone: A resident of Kiryat Ata filed a NIS 5,000 lawsuit in the Kiryat Ata Small Claims Court against the Kiryat Ata municipality and the Aita Springs water corporation, for damages caused to his new Tesla car, according to him, due to the defendants’ negligence.

The lawsuit letter states that the plaintiff drove in February this year on Kinneret Street in Kiryat Ata. “Suddenly the vehicle was hit by a hole that was open in the middle of the lane, and which could not be seen during the trip,” he noted. “As a result of the accident, the plaintiff’s vehicle, a new Tesla, was damaged in both tires.” He claims he had to change tires and also do wheel balancing.

Following the case, the plaintiff contacted the municipal center in Kiryat Ata, in order to report the dangerous safety hazard. According to him, the pit was covered after a few days. After changing tires in his car, he turned to the municipality’s legal department, which, after an inquiry, referred him to the water corporation, Kiryat Ata Springs.

The plaintiff notes that the water corporation is an arm of the municipality, and for him both bodies are equally responsible for the integrity of the roads. According to him, the very reference to the corporation by the municipality, after the matter has been clarified, constitutes a kind of recognition of the hazard.

He said after the referral to the corporation, he did not receive any response. “All of the plaintiff’s attempts in the chase between the two bodies to find out the status of the appeal remained unanswered, and one sent it to another.

In a call to Maynet Krayot, the prosecutor said: “At first I contacted the municipality, and they told me that the person in charge was the water corporation. I also contacted them, and received a reply that my request was accepted, “They are dropping the case on top of each other. I did not want to gain anything from this story, just to cover my costs, so I had no choice but to file a lawsuit.”

The plaintiff demands compensation in the amount of NIS 5,000, including expenses for the replacement of the tires, absences from the work day and mental anguish.

The Kiryat Ata municipality and the water corporation stated: “The lawsuit will be clarified in court.”
