A resident of the Brest region lost 3.2 million rubles earned on cryptocurrency trading, the press service of the Supreme Court reported.

From February to April 2023, a Belarusian bought and sold cryptocurrency on virtual exchanges. However, he was not registered as an individual entrepreneur.

The tax office found out that in three months of work, he managed to complete 456 transactions for a total of 3.2 million rubles.

The money from the sale was transferred by buyers to the cards of Belarusian banks registered in the name of the merchant. Part of the funds was transferred to Belarusian cards issued “for third-party unidentified individuals.”

The court concluded that the Belarusian was engaged in unregistered business activities. He was fined 30 basic units (1,110 rubles), with 100% of illegal income confiscated – 3,257,106 rubles.

The judgment was not appealed and entered into force.

Since the beginning of the year, the Economic Court of the Brest Region has considered six cases on the facts of transactions with cryptocurrency in violation of Decree No. 8 “On the development of the digital economy”.

“The subjects of administrative responsibility in cases of illegal transactions with cryptocurrencies were persons who purchased cryptocurrencies repeatedly, thereby allowing homogeneous economic transactions in order to systematically make a profit, bypassing the provisions of tax legislation,” the press service of the Supreme Court reported.

Judicial practice shows that the amount of income received from illegal transactions in the field of illegal circulation of virtual currency amounts to thousands and millions of rubles.

“According to the results of cases of administrative offenses considered by the economic court of the Brest region, the amount of the imposed fine ranged from 30 to 100 basic units, and the total amount of illegally obtained income subject to collection amounted to more than 5.5 million rubles,” the press service noted.
