Belgian and British Nationals Sentenced for Unauthorized Access to Classified Information

Two men, one from Belgium and the other from Great Britain, have been sentenced to prison for 1 year and 4 months by the district court for gross unauthorized position with secret information. The court found that the individuals had entered a highly secured base belonging to the navy on two occasions and had engaged in reconnaissance activities, filming and photographing without authorization.

The sentence, however, has been appealed by both the defendants and the prosecutor. The prosecutor, seeking a tougher sentence, was disappointed when the Court of Appeals instead reduced the sentence to imprisonment for 4 months, charging the men with a crime of the normal degree.

The Court of Appeals, in alignment with the District Court, acknowledged that the materials the defendants obtained were of significant concern to Sweden’s security. The films and images primarily captured the underground and highly protected areas of the Musköbasen facility. However, there is no evidence to suggest that the men had any intention to provide the material to a foreign entity.

The incident unfolded in December 2018 when a security guard discovered the men inside the base. Their subsequent arrest stirred concerns regarding the breach of security and the potential implications for national defense. The court’s judgement has shed light on the gravity of the matter, emphasizing the importance of safeguarding classified information related to the country’s security.

While the reduced sentence has sparked controversy, it remains to be seen whether further legal action will be pursued by either party.
