The CBI, which did not get any more than what the crime branch found in the Periya murder case, submitted to the court a fabrication prepared by the Congress leaders. The names of the CPI (M) leaders were added to the list of defendants to make it clear that many new things had been discovered before the expiry of the four-month period prescribed by the court.

The inclusion of KV Kunhiraman, a member of the district secretariat and former Uduma MLA, is also planned. The CBI was led by the conviction that it would not get media attention if it did not include at least one top party leader. The night after the murder, KV Kunhiraman was made the 20th accused in a false story that the accused, who was taken into custody by the Bekal police, was forcibly released and kept in a secret cell.

The CBI was admitting the lie spread by the Congressmen through some media. An earlier report by the Crime Branch had named some of the witnesses, including Congress leaders and their families, as defendants.

When no new evidence was found, minutes of seizure dramas from the party office ensued. When asked if he would commit a murder in a minute, the officials did not speak about it. The 15th accused, Kallotte Surendran, was a Congress activist. The Congress was disillusioned with the atrocities and decided to leave the party and join the CPI (M). Surendran was repeatedly assaulted inside the house by the slain Sarath Lal. According to the CBI, Surendran was involved in the murder in retaliation.

Surendran was charged after finding out that the first accused had called Peetambaran. The crime branch had found that Surendran was not in Periya at the time of the incident. The 17th accused, Raji Varghese, was found to have given an iron pipe to the killers.

Defendant assumed that Reggie was an electrician and plumbing worker and that such materials were in his possession. There is no evidence against the 18th accused Hariprasad and the 19th accused P Rajesh.
