The Superior Electoral Court (TSE) convicted Jair Bolsonaro, former president, by 5 votes to 2 in a new process, this time due to the electoral use of the national holiday of September 7, 2022.
In addition to condemning Bolsonaro for the second time to ineligibility for eight years, the Court disqualified Walter Braga Netto, a reserve general and former minister who was a candidate for vice president in the former president’s formula and who was emerging as a candidate for the Mayoral elections. of Rio de Janeiro in 2024.
Of the 7 magistrates, 5 considered that Bolsonaro committed abuse of power and promoted a campaign using public funds in the Independence Day celebrations.
Bolsonaro’s defense argued that the celebrations of the civic event occurred in an open and institutional manner.
The former president had already been declared ineligible for eight years by the TSE at the end of June, also by 5 to 2, in the case that dealt with a meeting with ambassadors in which he made attacks and spread lies about the electoral system.
The ineligibility period begins in 2022 and, under current legislation, Bolsonaro and Braga Netto could run again in 2030.
