Former president Jair Bolsonaro (PL) testifies to the Federal Police this Wednesday (26) about the acts of vandalism registered in Brasília on January 8, when the Planalto Palace, the National Congress and the Federal Supreme Court (STF) ) were invaded and plundered by extremists.

Bolsonaro’s name was included in a STF inquiry into the episodes of violence by decision of the case’s rapporteur, Minister Alexandre de Moraes.

The magistrate agreed to investigate the former president at the request of the Attorney General’s Office (PGR), who saw evidence of public incitement to the practice of crime by Bolsonaro when he published a video on social networks, a few days after the 8 January, in which he questioned the outcome of the 2022 presidential election.

The content was later deleted, but Bolsonaro would have incited the perpetration of crimes against the rule of law by sharing the recording, according to the PGR. According to the body, even if the post was after the acts of vandalism, the conduct of the former president must be investigated.

Bolsonaro’s defense guarantees that he never had any relationship with the extremist acts or participation in them.

One hundred involved have already become defendants

On Monday (24th), the Supreme Court concluded the first trial related to the acts of January 8th and found 100 invaders accused of the extremist acts that took place in Brasília. They will respond for criminal association, attempted violent abolition of the democratic rule of law, attempted coup d’état, threat, persecution and incitement to crime.

On Tuesday (25), the STF started another judgment that will define whether another 200 people involved in the episodes of violence should be turned into defendants. Minister Alexandre de Moraes has already voted in favor of this. In the vote, he stated that the Constitution does not allow the propagation of ideas contrary to the constitutional order or the holding of public demonstrations aimed at breaking the rule of law.

“It is not any critical manifestation that could be typified by the present criminal charge, as freedom of expression and pluralism of ideas are structural values ​​of the democratic system, deserving due protection”, said Moraes.

The judgment of ministers takes place in the virtual plenary until May 2. In this modality, magistrates vote through the STF system. If there is a request for a view, the vote is suspended. If there is a request for highlighting, the decision is taken to the physical plenary of the court.
