Brazilian Supreme Court will judge decriminalization of abortion

The Supreme Federal Court of Brazil released this Tuesday the case on the decriminalization of abortion up to 12 weeks of gestation for trial, although there is still no date for the trial.

The president of the Supreme Court, Rosa Weber, who is also the magistrate reporting on the case, decided that the trial on decriminalization can now be included on the agenda, six years after the issue came to court.

Once “released”, it will now be up to the president of the Supreme Court herself to decide when the matter is debated.

Weber has to retire at the beginning of October, when he turns 75, although he has the possibility of advancing the meaning of his vote before leaving his chair.

The judge, who has a liberal tendency, convened a public hearing with health professionals in 2018 and human rights NGOs to address what he described as one of the “most sensitive and delicate” legal issues.

The legal action was filed in 2017 by the PSOL, a left-wing party, considering that the abortion ban violated women’s right to equality, dignity, freedom and health.

Brazil, whose Congress is dominated by right-wing parties, only allows the termination of pregnancy in cases of rape, risk to the mother and fetuses with anencephaly.

Despite being on the left, the president, Luiz Inácio Lula da Silva, declared during the 2022 election campaign that he was against abortion and that, in any case, it was an issue that did not concern the head of state, but rather that of Congress.

43% of Brazilians oppose the legalization of abortion, compared to 39% who support it, according to a recent survey conducted by the data company Ipsos.

Support for termination of pregnancy has fallen nine percentage points compared to last year, according to this same survey.
