While the appeal is pending, Ninova still represents the party according to the register, despite the court’s decision to enter Zafirov as such

A heavy legal saga over who should represent the BSP and sign its documents looms large in the red ranks. Despite the court’s decision that this is now the temporary chairman Atanas Zafirov, the name of Cornelia Ninova continues to appear in the register of political parties.

The reason is that the July 10 decision of the Sofia City Court has not yet entered into force and the changes cannot be entered until it is clear whether they will be appealed to the Supreme Court of Cassation or not.

It was reached after Ninova resigned after the elections on June 9, and the National Council elected Deputy President Zafirov as the interim leader until a new leader is elected. Based on this decision, the court deleted Ninova as a leader and entered Zafirov as a representative, but this has not yet been reflected in the register, “24 Chasa” checked on Monday. The appeal period is 7 days from the notification of the parties to the case, but it has not yet run.

Due to the deadlock at the moment – one representative by court decision, but another entered in the register, BSP cannot submit its documents to receive the next tranche of the state subsidy,

to re-sign the contract with the regional administration for its headquarters

on “Positano” 20 and a bunch of other administrative decisions, informed people.

But the biggest drama looms around the signing and submission of the documents for the BSP’s participation in the coming early elections in the fall and the registration of the candidate lists.

Kornelia Ninova is the chairman of the BSP and any document signed by someone else is illegal. Ninova herself stated this to bTV over the weekend and gave a clear sign that the court’s decision on the entry of Zafirov will be appealed.

We are entering a serious legal saga, unfortunately. I am currently the chairman. The court’s decision to delete me has not entered into force, as there is an appeal period. Socialists from all over the country are calling me. There will be a second instance, it is not known when, that is, we are entering a difficult court procedure, Ninova also commented.

She clarified that her resignation has been submitted and there is no going back. But at the same time he warned:

I am the incumbent chairman and what they are doing will involve the BSP in very big trouble. Any document currently signed by another is illegal. They sign documents, run the de facto party,

they will talk about a government of some sort – they are not legitimate to do so

She explained that she offered her former deputies to sign a power of attorney for them to manage the BSP “normally”. They should not ruin the party because of their new-born self-confidence. As if we weren’t a team before, Ninova also commented.

Cornelia Ninova’s statement shows that her legal expertise in the case is a little lame, as this is an elementary legal interpretation. There is a court decision, accordingly there is a representative of the party and his signature is completely legitimate. Everything else is an attempt to sabotage the party and the consolidation process that is going on in the BSP and in the left political space. Such behavior is currently destroying the image of the institution that Mrs. Ninova represented until Wednesday, and the image of the entire party, Atanas Zafirov answered her in absentia from Nova TV.

According to him, if it comes to elections,

neither he, as temporary chairman, nor Ninova will approve the lists

Because they are approved by the National Council of the BSP.

His colleague and head of the red group in the parliament Borislav Gutsanov also announced that the new leadership of the party is legitimate, registered in the court and has the right to make decisions. To be honest with you, it’s a bit like a split personality. Hem you resign, then attack your own resignation in court, but at the end of the day it’s Ms. Ninova’s right. The court’s decision is this. From now on, we follow our bylaws and regulations. Does the new management have the right to sign, to take any actions – of course they do. The new leadership is working to unite within the BSP people who are offended, to the entire left space and especially to the presidential institution to stop this cold war, commented Gutsanov to bTV.
