If he wanted to show again that his hand is not shaking, the government has chosen the right time. In the Official newspaper Sunday, June 4, he published the first two implementing decrees for the pension reform. These are intended in particular to specify the conditions under which the legal age of departure is postponed – the flagship measure of the law of April 14 against which the organizations of employees and the defense of youth are demonstrating on Tuesday, for the fourteenth times since the beginning of the year. The publication of these texts “is a provocation, an arm of honor sent to the people, two days before the call for mobilization”denounced Clémentine Autain, the deputy La France insoumise of Seine-Saint-Denis.

The decrees in question were eagerly awaited because they contain provisions whose entry into force, for almost all of them, is scheduled for 1is september. These relatively tight deadlines put pressure on the services of some forty existing schemes, including the National Old-Age Insurance Fund (CNAV) within which former private sector employees emerge.

The implementing texts set out the way in which the age of entitlement to a pension will be gradually raised. Currently set at 62 years for insured persons subject to the common rule, it will be increased to 62 years and three months for those born between 1is September and December 31, 1961, then will increase by one quarter per year of birth, reaching 64 years for those who were born from 1is January 1968.

This gradual postponement of two years also affects women and men who benefit from derogations. This situation includes civil servants carrying out arduous or dangerous jobs, who come under the categories known as « super-actives » et « actives » : the minimum age will gradually increase from 52 to 54 years, in the case of the former (police officers, sewer workers, prison staff, etc.), and from 57 to 59 years for the latter (caregivers, etc.).

Pressure on CNAV agents

The decrees also materialize the overhaul of the system of “long careers”, which offers individuals who started working young the option of leaving earlier than others. Henceforth, there will be four ages for the opening of pension rights, compared to two today: 58, 60, 62 and 63, for those who started their professional life at 16, 18, 20 and 21 (under subject to having contributed for a certain number of quarters). A small surprise, in favor of the insured: those who were born between the 1is September 1961 and December 31, 1963 will have the opportunity to take advantage of a “safeguard clause”. It will allow those who can operate the system of “long careers” before 1is September 2023 to remain eligible for it if they continue to work beyond this date (the conditions for being entitled to it become more demanding from 1is september). Some 8,000 people are affected, according to figures revealed by The echoes which was confirmed at Monde.
