As sexual exploitation crimes using deepfakes (image synthesis based on artificial intelligence) have recently emerged as a global problem, California, home to Silicon Valley, the mecca of the U.S. information technology (IT) industry, has taken steps to regulate them. The plan is to punish not only the creators but also those who distribute or possess deepfakes that express sexual exploitation of minors, even if they are virtual characters. If Democratic Governor Gavin Newsom signs the bill before the 30th of this month, California will become the first of the 50 states to introduce comprehensive regulations on AI deepfakes.

AP and other news agencies reported that the California state legislature passed bills containing such content on the 31st of last month (local time). Originally, U.S. law, which emphasizes freedom of expression, did not punish deepfakes because it was not considered illegal if the characters in the deepfakes were not real people, but the state legislature declared that it would regulate them more strongly.

Recently, in Korea, the Seoul Metropolitan Police Agency arrested a man in his 20s who produced 279 deepfake sexually exploitative materials on Telegram. The number of victims reached 246.

As the presidential election approaches, the California state legislature also introduced a bill that strengthens regulations on deepfakes related to elections, as well as sexual exploitation materials. It prohibited the production of deepfakes related to elections, and required social media companies to regulate deepfakes for election content starting 120 days before the election. It also created a way for election authorities or candidates to claim damages if they do produce them. However, the bill made an exception for productions intended for satire.

Recently, a supporter of Republican presidential candidate and former President Donald Trump created a controversy by using deepfake to create a video that slanders Democratic presidential candidate and Vice President Kamala Harris. In the fake video, Harris says, “President Joe Biden is actually senile and I don’t know a thing about running a country.” The controversy grew even more intense because the voice in the video is similar to Harris’s real voice.
