With the holidays approaching, many are wondering if they will be able to take their dogs with them to the beach. It is allowed? Are there any limitations? And does something change between the sea and the lake? Let’s see almost are the general rules and prohibitions to which attention must be paid to avoid fines.
General rules
Let’s start with the main question. Can dogs be taken to the beach? Yes and no. Beaches, just like parks and nature reserves, are environments which, by law, provide for access in compliance with the rules issued by Municipalities, Organizations, as well as by the Port Authorities which have jurisdiction over state property and beaches. But at the regulatory level, at the moment, there is no real national law on the subject. Even in the absence of specific prohibitions, logically, it is always necessary to respect the behaviors envisaged for the access of animals to any public place, starting with the compulsory use of the leash and waste bags. Law and deontology, on the other hand, require that there be no restrictions for guide dogs and rescue dogs other than those in force for humans.

Free or private beach?
For free beaches, every year the Regions issue a bathing ordinance in which they fix all the prescriptions concerning the access and use of the beach, then leaving the Municipalities the possibility of determining the areas accessible to dogs. It is useless to deny that unfortunately there are still limiting municipal ordinances, but the prohibition must always be marked and clearly visible at the access to the beach. Beware that there may be timed bans, with access allowed only at certain times of the day. If you frequent private establishments, beaches, individual concessionaires can dedicate specific areas to dogs or free access to the entire establishment, with municipal authorisation. But you need to know that the shoreline area, i.e. those 5 meters that divide the sea from the beach, are a transit area of the state property, with free use and transit: this means that you can pass even if the establishment imposes a ban on the presence of the dogs, but it is still forbidden to stop.

The sanctions
Anyone who doesn’t follow the rules is liable to prosecution. But the penalties are always pecuniary and can vary with figures ranging from 25 to 100 euros depending on the different municipal systems. In jurisprudence, the freedom of the person to go to the sea with the dog is guaranteed with respect for others, such as for example in hygiene, decorum and the safety of other bathers, this can therefore lead to different types of sanctions, as well as fines “cumulative” that can reach even one thousand euros. And even if there is a ban on access to dogs, it is always forbidden to leave your dog in the car, even for a short time: in this case we could be sued for mistreatment, as well as putting our pet’s life at serious risk .
