Apart from the alleged irregularities that kept them alive from 2021 to Citizen Prosperitythe resolution of the Sixth Chamber of Administrative Litigation that granted the provisional protection against the registration of the ordinary assembly of the party, the court invoked the “possible omission” of the requirements demanded by the Electoral Law.

Despite the “brief report and the incomplete record of the requested protection”as described by the amparista court in its resolution, validated the arguments of the amparo requested by the Cambio party, where detailed defects were noted that the Citizens Registry should have identified and even so, it gave its endorsement for the registration of the ordinary assembly of 20 November 2022, where former Minister Antonio Malouf was elected as Secretary General of Citizen Prosperity.

Although Ramiro Jose Munoz Jordanholder of the Registry of Citizens, was the one who gave the go-ahead for the registration of the assembly, it was not he who sent the report to the Chamber but his representative, Eleonora Noemi Castillo Pinzónbecause Muñoz requested a permit to be absent from his work for three days, returning on Friday, May 19.

The Supreme Electoral Tribunal confirmed that Muñoz returned to work on the indicated day. Therefore, it will be he who sets the scope of the amparo granted, as resolved by the Sixth Chamber.

The possible imminent consequence is to annul the meeting of November 20, 2022, and everything that has been done subsequently, including the extraordinary meeting of February 5, 2023, where Carlos Pineda and Efraín Orozco were proclaimedas presidential binomial, as well as candidacies for deputies.

Among the vices identified by the Cambio party, which processed the amparo, and which according to the Sixth Chamber “cannot go unnoticed” are:

  1. The Assembly was installed with a quorum of eighty-one delegates from forty-eight municipalities, of the quorum, the signatures of the delegates were not presented; only the credentials and a list of those who attended the assembly in relation. The National Executive Committee failed to submit, for its approval, the economic reports themselves, which should have been approved by the National Assembly.
  2. The political party did not present a financial report to the National Assembly. An infraction is incurred by not making use of and applying the minority distribution system, having proposed three forms and elected only one in its entirety; and in accordance with article 31 Ter of the Regulation of the Electoral Law and of Political Parties; the infringement of the mandate of the law will cause the nullity of the assembly in question.
  3. A delegate was proposed without establishing the name of the municipality represented; incurring in the vices when proposing the forms: Form 1: names of municipalities represented are not established.
