A man accused of attacking his daughter with a knife in Gijón has acknowledged having violated the precautionary measure to restrain the victim imposed by the Investigative Court No. 5 after the attack and has accepted a 6-month prison sentence.

The Gijón Area Prosecutor’s Office, taking into account the nature of the facts, opposed the suspension of the execution of the custodial sentence, requesting the detainee’s entry into prison for its execution. The quick trial took place in the Investigative Court No. 5 of Gijón.

Said court had agreed, by an order that was notified to the investigated, the prohibition of approaching his daughter and his home in Gijón, within the framework of the previous proceedings initiated in that same judicial body for an alleged crime of attempted homicide. With that resolution in force, the man failed to comply with the prohibition and was detained inside the house.

The facts were considered to constitute a crime of breach of sentence or precautionary measure of article 468.2 of the Penal Code. After acknowledging the facts contained in the Prosecutor’s Office’s accusation, the accused accepted a sentence of 6 months in prison (the 9 months in prison initially requested by the Prosecutor’s Office, with the reduction of one third provided for in the law when the accused showed his agreement. ), with special disqualification from exercising the right to passive suffrage during the time of the sentence.
