The magistrates consider that “no violation of the presumption of innocence, nor of the ‘in dubio pro reo’ principle, is apparent in the appealed sentence, but there is also no basis to consider the existence of an error in the assessment of the evidence” by of the judges of Valladolid, who also motivated “the tests carried out in a sufficient and totally correct way.”

The TSJ rules out that the convicted man acted on the orders of another inmate whom he feared and who was acquitted by the Valladolid Court for not having been proven his participation in the fire that spread through the module and endangered the life and physical integrity of officials. and prisoners.

The magistrates of the Castellano-León high court, as the Valladolid Court already did, refuse to apply the circumstance of insurmountable fear to the inmate who set fire to the mattress as a mitigating or exonerating circumstance.
