The Superior Court of Justice of Castilla y León has confirmed the four-year prison sentence of an inmate of the Soria Penitentiary Center for a crime of injuries that attacked his cellmate. The court confirms the ruling of the Provincial Court that also sentenced him to compensate the injured party with 24,300 euros for the injuries and consequences caused.

The proven facts relate that on the morning of August 25, 2019, the accused attacked his cellmate while he was lying on his bunk, throwing bleach on his face and body and then giving him several cuts on his face, head, back and thorax with the lid of a canned food folded like a skewer. As a result of the attack, the victim suffered multiple injuries, irritation and slight keratitis in his eyes.

The magistrates express their agreement with the reasoning and jurisprudence invoked by the trial chamber, which, after reviewing not only the expert evidence performed, but also directly and personally appreciating the scars at the trial, considered that the multiple cuts suffered by the victim on the face, which have left significant scars, justify the application of the type of deformity of article 150. “The sentence reaches the condemnatory conclusion by correctly evaluating the direct evidence provided (testimony of the victim and several prison officials who appeared at the scene of the events immediately), as well as the objective data that emerge from the medical reports and the forensic documentary evidence, which becomes evidence suitable to undermine the right of presumption of innocence, and this despite the fact that the “accused denies the facts,” says the Chamber.
