The Second Section of the Provincial Court of Castellón has sentenced a man who had sexual relations with his wife’s son to 13 years in prison for a continuous crime of sexual assault after threatening to hit him if he did not agree.
The Chamber also imposes a prohibition on approaching within 500 meters of the victim and communicating with her by any means for a period of 20 years. The man must compensate the injured party with 10,000 euros for moral damages.
According to the account of proven facts contained in the resolution, the attacks began around 2020 inside the home that the stepfather and the victim shared, when on at least five occasions the man adopted an intimidating attitude and, after threatening the young man, He subjected him to different sexual practices.
The victim, who was 17 years old when the events began, has a deficit in learning capacity and has a recognized moderate degree of disability, which weakens her ability to grant express consent to have sexual relations and is easily manipulated and influenced.
The sentence is not final and can be appealed before the Civil and Criminal Chamber of the Superior Court of Justice of the Valencian Community.
