The Supreme Court on Wednesday agreed to hear a plea filed by Samajwadi Party’s Muhammad Abdullah Azam Khan, who is now in Uttar Pradesh after being convicted in a 15-year-old case and sentenced to two years in prison. He has been disqualified from the Legislative Assembly. given ,
“We will take it up on the 5th (April 5, 2023),” the apex court said after a brief hearing by senior counsel appearing for Khan, according to the English website livelaw.
Khan has filed a petition in the Supreme Court to stay his sentence. He had earlier appealed to the Allahabad High Court, but when the matter came up for hearing on March 17, 2023, the High Court adjourned the hearing for three weeks and granted no adjournment. As a result, Khan was concerned that the election process for his vacant seat could be announced at any time as he had already been disqualified.
During the hearing before a bench of Justices KM Joseph and BV Nagaratna, Khan’s senior counsel told them that on March 29, 2023, the Election Commission had announced that the election process would begin from April 13, 2023. It was argued that Khan was convicted in 2008 in a crime along with his father Azam Khan, who was on strike at the time. The police registered a case against Abdullah Khan, who was a minor at the time. However, the trial court sentenced him to a maximum sentence of two years. The senior lawyer said that the next day Khan was disqualified from the assembly and his seat was declared vacant.
