Chamber admits Amparo in favor of a teenager who disappeared in 2011

San Salvador. The Constitutional Chamber admitted on Wednesday, April 19, an Amparo appeal in favor of a 14-year-old adolescent who disappeared in 2011 and who is still wanted by his relatives.

The appeal was filed in favor of the adolescent, through the Foundation for the Study for the Application of Law (Fespad), which filed the appeal until November 24 of last year.

Identified only as Josué, the Chamber has assigned the reference number 314-2022 to the Amparo through which it seeks to find out who is responsible for this disappearance, the same on which there is no conclusive investigation, warns Fespad in his letter.

Josué’s mother awaits an exhaustive investigation by the Attorney General of the Republic, which will allow the whereabouts of the disappeared person to be found; neither in the administration of Raúl Melara nor in that of Douglas Meléndez was any investigation opened. At this time the inquiries remain unopened.

In the Amparo, Fespad claims against the omission of the Legislative Assembly for not issuing regulations that contribute to making the process of locating or identifying a disappeared person efficient and to guarantee psychosocial support to the family group.

In addition, the Amparo lawsuit requested the granting of precautionary measures, such as ordering the FGR to carry out investigative proceedings on the case; and the Ministry of Health, provide specialized care to Josué’s family group and any person in a similar situation.

But the lawsuit was only admitted against the Attorney General of the Republic, “by virtue of the possible injury to the rights to judicial protection -in its manifestation of the right to access to the jurisdiction- and to know the truth”; The Chamber rejected the admission regarding the demand made to the Legislative Assembly and the granting of a precautionary measure in relation to the case.

Although the admission is partial, Fespad valued this act as “of great importance for Josué and his family.”
