The Chilean Chamber of Deputies passed a law that expands the powers of the Carabineros and Investigative Police (PDI) to carry out identity checks and face the migratory crisis that the country is experiencing.

The modifications implemented by this law, which was approved by 86 votes in favor, 44 against and five abstentions, suppresses the limited time of one hour, which is replaced by an indefinite time, for a police officer to stop and “make available ” of the PDI to the person who cannot prove their regular immigration status.

Besides, Deletes the phrase that prohibited police identity checks based on discriminatory reasons, allowing officers to carry out checks directly without this restriction by law.

The last point is related to the attributions over the control of identity and registration in the areas of border areaswhich will be granted to the Armed Forces on a temporary basis, who will be able to support Carabineros and PDI in identity control and that it is not an exclusive task of these institutions.

The regulation is in response to the immigration crisis that the country is experiencing and seeks to help corroborate the immigration status of people and initiate the corresponding procedures in accordance with the law, according to the President’s Government Gabriel Boric.

According to data from the National Institute of Statistics (INE), with estimates as of December 31, 2021, the foreign population residing in the country is 1,482,390, representing an increase of 1.5% compared to the same date in 2020. and an increase of 14.1% compared to 2018.

The director of the National Migration Service, Luis Thayer, told Radio Cooperativa that between 2018 and 2021 there were nearly 9,000 cases in the Justice of irregular entry. In addition, he explained that, according to data provided by the Carabineros, 400 people a week are entering through the Tarapacá region, 1,800 kilometers north of Santiago, on the border with Bolivia, and it is estimated that in 2021 “56,000 people entered through unauthorized passages.” .
