Pastor Choi Jae-young’s side protested the Supreme Prosecutors’ Office’s Prosecution Investigation Review Committee’s decision not to indict Ms. Kim for the alleged receipt of luxury handbags, saying it was an “expected conclusion.”

Attorney Ryu Jae-yool, representing Pastor Choi, said in a phone call with Newsis on the 6th regarding the committee’s conclusion, “There should be a punishment provision for violating the Anti-Corruption Act, but since there is none, the committee members are unable to express an opinion to indict even if they determine that ‘there was a request. ‘”

Attorney Ryu said about the fact that the Supreme Court reviewed not only the Anti-Corruption Act but also mediation bribery, violations of the Attorney-at-Law Act, abuse of power, destruction of evidence, and bribery, “The prosecution only reviewed the legal principles of mediation bribery, violations of the Attorney-at-Law Act, and abuse of power,” and explained, “Pastor Choi should have been summoned for review, but he was never questioned. The prosecution did not investigate.”

He said, “Abuse of power only applies to public officials, but Ms. Kim is not a public official,” and “That’s why the prosecution did not say that they investigated, but rather that they reviewed the legal principles.”

He continued, “The law alone is not enough; it should have been confirmed through an investigation. When the committee was opened in this way, the members of the investigation committee were unable to do anything they wanted to do,” adding, “Since the members did not conduct an investigation, they are structurally unable to express an opinion to indict.”

Attorney Ryu argued, “The prosecution must have known the results of the investigation committee,” and “if not, they should have included the matter of whether to continue the investigation in the agenda for deliberation.”

Pastor Choi’s side repeatedly emphasized that the bag submitted to the prosecution by Ms. Kim’s side for identity verification was not the bag that he had delivered.

It has been reported that the Seoul Central District Prosecutors’ Office’s 1st Criminal Division (Chief Prosecutor Kim Seung-ho) compared the bag voluntarily submitted by Ms. Kim with the bag in the video filmed by Seoul Voice at the department store and concluded that they were the same product.

Attorney Ryu said, “The identity of the bag has not been verified,” and added, “I have a photo of the serial number inside the bag. You can compare them.”

The suspicion that Mrs. Kim received a luxury bag was raised when Pastor Choi visited the office of Cobana Contents in Seocho-gu, Seoul in September 2022 and filmed himself giving Mrs. Kim a luxury bag worth 3 million won, and the Voice of Seoul released the video in November of last year.

The Seoul Central District Prosecutors’ Office investigation team reported the results of the investigation, including the decision of not guilty against Mrs. Kim, to Prosecutor General Lee Won-seok on the 22nd of last month. After receiving the report from the investigation team, Prosecutor General Lee used his authority to refer Mrs. Kim’s case of violation of the Anti-Corruption Act to the Investigation Committee.

The president evaluated that the investigation team’s investigation was conducted faithfully, but explained the background, saying, “It is desirable to tie up the case through the investigation review committee procedure to improve fairness and prevent any further controversy.”

The Supreme Prosecutors’ Office held a committee meeting at 2:00 PM on that day at the Supreme Prosecutors’ Office in Seocho-gu, Seoul, and announced, “We have decided not to indict suspect Kim Gun-hee on all charges.”
