Long controversy over the “Edda” pug: the plaintiff loses on appeal

Pug “Edda” has produced many titles. Its owner, who purchased the dog via an online portal in 2018, is now being rejected after a long dispute in the Hamm Higher Regional Court.

Almost six years after purchasing the pug “Edda” in 2018 Classified ads on eBay and a long-running dispute over the dog’s health at the time, the buyer also failed in an appeal before the Higher Regional Court in Hamm. The plaintiff’s appeal was rejected after Monday’s hearing, the Higher Regional Court later announced. “The Senate did not allow the review.” This means that legal remedies are no longer possible. The decision puts an end to the legal tug-of-war in the case, which also caused an outcry internationally.

The buyer, a police officer from the Mettmann district, purchased the pug via the online portal of the Westphalian city of Ahlen at the end of 2018 for 690 euros. A city employee offered the animal via his account and described it as healthy. The dog had previously been seized by the Municipality from a debtor.

The plaintiff believes she was deceived about the animal’s health and demanded a five-figure sum from the city. According to the OLG spokesperson, she wanted to ensure that the city would also cover the future costs of treatment.

The dog’s owner spoke of still high treatment costs

The applicant had already been successful in her claim for damages before the Münster Regional Court in April 2023. She was only awarded around 226 euros plus interest for the vaccination costs, which the municipality had to pay. The regional court then did not consider it proven that the animal had not been dewormed at the time of sale and that it had various eye diseases, as described by the plaintiff. However, the dog’s owner turned to the Hamm court, where she failed again in the last legal act.

The portal on which the pug was sold in 2018 is no longer called Ebay Ads, but Announcements. An eBay spokesperson also clarified that these are two independent companies and platforms, officially separated since May 2023. The sale of animals is not allowed on eBay.
