“The recent ruling of the Constitutional Court, which cancels the temporary block on new tenders for the release of chauffeur-driven rental authorisations, the ministerial decree of 2 July which established the RENT (National Electronic Register of Taxis and NCCs) and two other long-awaited decrees, the Prime Ministerial Decree regulating technological platforms and the ministerial decree on the electronic service sheet, are changing the regulatory framework of the passenger transport sector”, comments CNA on the developments related to the regulatory framework of taxis and NCCs.

“The Municipalities of Bolzano and Merano, both engaged in the reorganization of the Taxi service and in the rewriting of the municipal regulations, should take this into account by promptly implementing the changes”. The risk, according to the category, is that the new municipal regulation of Bolzano, already drafted and filed both in the City Council and in the investigation of the Transport Regulatory Authority, will have to be modified again shortly before the final approval. The Municipality of Merano, which is now starting the process, seemed to have plenty of time to adapt to the new regulatory framework.

“The blocking of the release of new rental authorizations from garages, previously considered legitimate in the ruling n.56/2020 of the Consulta – evidence CNA Taxi – should have had a duration of one year, the time strictly necessary to establish the national electronic register, with which to quantify the real and effective number of operators in the Taxi and NCC sector present in Italy, a figure still unknown to date. In recent weeks, after a lack of interest lasting more than five years by various governments, the executive has proceeded to establish the National Electronic Register, unblocking a situation that had been dragging on for too long. As soon as the Prime Ministerial Decree regulating technological platforms and the ministerial decree on the electronic service sheet are launched, there will be a context of certain rules, as provided for by law 12/2019 for the sector, which will allow the Municipalities to evaluate the optimal number of licenses to issue and the correct procedure for tenders, in which to specify any new regulations, also taking into account the Autonomy of the Province in this area”.
