Constitution not clear: AB party lawyers

The leaders of AB Party Lawyers, the lawyers’ organization of my Bangladesh Party, said that in the current situation, it is not clear whether the constitution of the country is active or has been abrogated. They called for the removal of constitutional ambiguities as soon as possible, saying that various articles of the constitution are running on the basis of random pick and choose. Which can create complications at any time.

They said these things at a press conference at the central office of AB Party in Vijay Nagar on Tuesday (September 3) afternoon.

Barrister Sani Abdul Haque, Assistant Member Secretary of AB Party and Joint Member Secretary of AB Lawyers, presented the keynote speech highlighting various inconsistencies in the oath of the interim government and the constitution.

Barrister Asaduzzaman Fuad and Barrister Jobair Ahmed Bhuiyan answered various questions of journalists.

Barrister Sani said, in the speech given by the chief advisor to the nation on August 25, many issues including democracy, human rights, foreign policy were raised, but we did not get any statement about the constitution. It is not clear whether the country’s constitution is active or abrogated in the current situation. The government needs to give a clear explanation on this. Inconsistencies need to be addressed immediately or serious complications may arise. Therefore, a presidential ordinance should be issued on this very soon. If we review the history of the modern state system, it can be seen that the government formed after the people’s coup made radical changes to the constitution to reflect the public will, but we do not see anything like that in this government.

Barrister Sani proposed the following amendments to the Constitution—

1. Article 7B. The fundamental provisions of the constitution are not amendable.
2. Article 70. If you vote against the political party or leave the party, the membership of parliament is cancelled.
3. Balance of power between the President and the Prime Minister.
4. Judge Appointment Process (Judiciary Reform).
5. Referendum

Barrister Fuad said that the constitution of 72 was framed based on one person without any reflection of the constitution that was the desire of the people after the war of liberation. The Declaration of Liberation War clearly mentioned that this state will be based on equality, human dignity and social justice. But we got a constitution that gave birth to a dictatorship and fascism in a democratic way. A prominent example of this is the A.League regime of 72-75 and the previous racist, genocidal government led by Sheikh Hasina.

He said, in the post-coup situation, radical change of the constitution in the light of public desire is the need of the hour. He said that for the sake of keeping the constitution intact, the reforms of the interim government should not fail in the future.

AB Party Secretary Advocate Abdullah Al Mamun, Metropolitan North convener Advocate Altaf Hossain, AB Lawyers Joint Member Secretary and Office Secretary Advocate Ali Nasser Khan, Assistant Member Secretary Advocate Tarek Abdullah, Advocate Sharan Chowdhury and other leaders of AB Lawyers were present.
