The Constitutional Drafting Assembly called on the United Nations mission to support the constitutional process in Libya, not to drag its people into more mazes, and to enable the Libyans to have their say through a general referendum.
In a letter to the new UN mission’s Chargé d’Affaires, Stephanie Khoury, the body urged that the issue of completing the remaining stages of the constitutional process be given priority in any political dialogue supported or supervised by the mission.
The members of the Constitutional Communication Committee of the Commission also called for correcting the mission’s path and returning it to the truth, and for it to end its perceptions that reduce the people to parties that it chooses and consults with in “closed rooms,” and supervises their outcomes, according to the statement.
The Commission considered that the constitutional path can only be determined through a referendum first, then elections according to a permanent constitution, and that the mission must abide by the text of the law, the rulings of the judiciary, and the spirit of the United Nations Charter and Security Council resolutions.
The Commission pointed out that the previous special envoys ignored the completion of the constitutional process and deviated from the essence of their primary mission, which is to support the Libyans in ending the transitional phase.
The Commission considered that the mission responded with great ease to the motives of certain internal and external figures and groups, and ignored the right of Libyans to a referendum on its project since it was approved in 2017, and rushed to adopt mechanisms that distort the law and disregard judicial rulings, according to it.
The Commission added that the current visions presented by the mission gradually distance the Libyans from the principle of the rule of law and deprive them of their right to accept or reject a draft constitution drawn up by the Commission, which increases division and discord, according to it.
