The Constitutional Court of Ecuador (CC) rejected the six petitions for unconstitutionality presented against Executive Decree No. 741, with which the death cross was executed to dissolve the National Assembly. Thus, the legality of the measure is ratified applied by the President of the Republic, Guillermo Lasso.
On Thursday, May 18, 2023, the three courts that make up the CC Admission Room, made up of the judges of this Body, issued six writs in which the lawsuits were analyzeds of unconstitutionality filed against the Decree. In all the cars, the courts they unanimously decided to reject the claims of unconstitutionality.
As a consequence of the decision to reject the claims of unconstitutionality, also requests for the Court to adopt precautionary measures were rejected in order to provisionally suspend the effects of the challenged Decree.
In the six orders issued, it is emphasized that neither the Constitutional Court nor any other judicial authority in the country “they have competence to rule on the verification and motivation of the cause of serious political crisis and internal commotion, invoked by the President to dissolve the National Assembly based on article 148 of the Constitution.”

Another came from the lawyer Carlos Alvear and three other people, who demanded that the Court grant precautionary measures to stop this measure.
