Conviction by the Council of the Order of Physicians of the child psychiatrist Eugénie Izard for having alerted to possible acts of mistreatment of a minor

DEBRIEFING – After that of child psychiatrist Françoise Fericelli, it is the testimony of another specialist, Eugénie Izard, that we collected. This child psychiatrist was also prosecuted and condemned by the Council of the Order of Physicians for having notably reported her suspicions of mistreatment of one of her young patients.

Concerning Eugénie Izard, the sanction for interference in family affairs is heavy: 3 months’ ban on practicing, including one month suspended. Since our meeting, the conviction has become final, the Council of State having refused to admit the appeal filed by the child psychiatrist with a view to annulling the disciplinary decision. In particular, it was considered that the letter addressed to the President of the Regional Council by the specialist did not constitute a report, but should be considered as a “simple mail”. The presidents of the Regional Councils are, however, at the head of the Cells for Collecting Concerning Information (CRIP), and the Code of Social Action and Families provides in its article L 226-3 what “the president of the departmental council is responsible for collecting, processing and evaluating, at any time and whatever the origin, concerning information relating to minors in danger or who risk being in danger. The representative of the State and the judicial authority provide their support”. Eugénie Izard announces that she will take the case to the European Court of Human Rights. This Tuesday, September 12, the government launched a campaign described as a “shock” to combat sexual violence against children. And on September 6, the Council of Europe made public a recommendation aiming “to strengthen national systems for professionals and volunteers for reporting all forms of violence against children, as essential elements of national strategies to combat and prevent violence against children children.”

The European institution deplores in particular that “Professionals working with children frequently face barriers to reporting when confronted with indications of child abuse, while children often do not have access to counseling and reporting services safe, adapted to their needs, and reliable.

It seems that France still has a way to go to lift the “barriers to reporting” standing up to doctors suspecting acts of abuse, sexual or otherwise, committed against children. We can indeed question the effectiveness of a campaign encouraging people to lift the “too well kept secret” sexual violence against minors, as long as professionals reporting their suspicions remain at the mercy of sanctions!
