Couldn’t attend church meeting; Lakshadweep MP Faisal in Supreme Court to withdraw disqualification

New Delhi: Former Lakshadweep MP Muhammad Faisal approached the Supreme Court against the non-revocation of the order disqualifying him from membership of the Lok Sabha. The petition has been filed alleging that the Lok Sabha Secretariat is taking an illegal passive approach.

Lakshadweep MP Muhammad Faisal was disqualified after he was sentenced to ten years in the attempted murder case. The order in this regard was issued by the Lok Sabha Secretariat on January 13th.

On January 25, the Kerala High Court had stayed the verdict that Faisal was guilty. In this situation, Faisal had written to the Lok Sabha Secretariat requesting the withdrawal of the disqualification order. But the Lok Sabha Secretariat has not yet issued an order withdrawing the disqualification.

It has been pointed out in the petition that the Election Commission has withdrawn the decision to hold the by-election in view of the stay order of the High Court. In the petition, Faisal also asks why the Lok Sabha Secretariat, a constitutional body, cannot withdraw his disqualification if the Election Commission, a constitutional body, can take action on the basis of the High Court action.
