Court decides to close church alleging disturbance of peace

In several parts of Brazil and the world, it is part of the functioning of Christian churches to use sound equipment, such as sound boxes and various musical instruments, which naturally produces sound volume. But, unfortunately, in some cases, denominations end up denounced for disturbing peace, becoming targets of Justice.

This is what happened to a branch of the Maranatha Christian Church Presbytery Espírito Santense, located at Avenida Visconde de Nácar, 765, in the São Francisco neighborhood, in Curitiba, Paraná.

The name became the target of a complaint (public civil action) filed by the Public Prosecutor’s Office of Paraná (MPPR), through the Public Prosecutor’s Office for the Protection of the Environment in the capital of Paraná.

In the lawsuit it is said that the church would be committing a disturbance of peace due to the sound volume produced in the temple. As a result, on the 3rd, the Judgment of the 13th Civil Court of the Comarca determined its closure.

In the decision, the Court says that the church cannot function while “the location and operation permit issued by the Municipal Secretariat of the Municipality of Curitiba, with specific permission to perform mechanical and/or live sound and a permit issued by the Municipal Sanitary Surveillance, is non-existent. , valid and up-to-date, and as long as there is no approval by the Municipal Secretariat for the Environment of Curitiba of the containment and acoustic insulation project and the conclusion of the corresponding works, in order to prevent sound emissions above the maximum permitted standard.”

Adjustments

With the court order, the Maranatha Christian Church Presbytery Espírito Santense has a period of 180 days to adapt to the requirements of the Comarca, which includes the elaboration of an acoustic project, so that it can return to work.

In case of non-compliance with the decision, the denomination will be subject to a daily fine of BRL 1,000, “without prejudice to the specific order to close the establishment in the event of compliance with the sentence”, according to information from the portal. Well Paraná.
