Court suspends charges for 123milhas installments on credit card

SÃO PAULO, SP (FOLHAPRESS) – The Court stopped charging travel installments on the credit cards of 123milhas customers, according to a decision published on Thursday (23) by the Court of Justice of Minas Gerais.

Judge Shirley Fenzi Bertão accepted part of the appeal by the Collective Defense Institute, which filed a lawsuit in September.

He requested the suspension of credit card charges for remaining installments owed to the company that were disputed by consumers before the invoice was due.

The judge emphasizes that, if someone must suffer losses as a result of the non-provision of services by 123milhas, such burden must be imposed on the financial institutions or the company that caused the damage.

“I partially grant the request for anticipation of the protection of the appeal claim to determine the suspension of charging by credit card for the remaining installments owed to 123miles, which were duly contested by consumers at least ten days in advance from the date of due date of the invoice, restricted to those who did not receive service provision.”

The fine for non-compliance is R$2,000, limited to R$20,000 for each consumer.

123milhas had filed for judicial recovery at the end of August. However, the process was suspended by the courts on September 20. In the same month, MaxMilhas, another company that belongs to the founders and brothers Ramiro and Augusto Júlio Soares Madureira, also went into recovery.

Companies used the sale of miles as a form of capitalization, especially in the Covid-19 pandemic, between 2020 and 2021. But this is an area in which the same company sells the miles and determines how many are needed to buy a ticket. This inflated the market.
