The court suspended the fine imposed on MBC for reporting on President Yoon Seok-yeol’s ‘vulgar language controversy’ during his visit to the United States in 2022.

According to the court on the 27th, the 8th Administrative Division of the Seoul Administrative Court (Presiding Judge Jeong-hee Lee) cited MBC’s application for suspension of execution filed against the Korea Communications Commission (KCC) the day before to suspend the effect of the imposition of fines.

The court decided, “The effect of the 30 million won fine imposed by the Korea Communications Commission on MBC on June 11 will be suspended until the date of the decision on the main case.” Accordingly, the fine against MBC will be suspended until the main lawsuit, the lawsuit to cancel the imposition of the fine, is pronounced.

Previously, the Korea Communications Standards Commission (KCC) decided in April to impose a fine of 30 million won on MBC for including vulgar subtitles in connection with President Yoon’s 2022 visit to the United States. The National Defense Commission held a general meeting last March and decided to impose a fine on the broadcast.

MBC objected to this and filed a lawsuit to cancel the imposition of fines last August and applied for a suspension of execution.

Meanwhile, MBC’s subtitle said that after the 7th financial pledge meeting of the Global Fund held in New York on September 21, 2022 (local time), President Yoon said, “If these XX members of the National Assembly do not approve, what will Biden do because he is embarrassed?” I put it in.

In response, the President’s Office countered, saying, “We said, ‘If the National Assembly does not approve it, we will blow it up.’” The gist of the argument is that it was ‘Nallimyeon’ rather than ‘Biden’.

In December of that year, the Ministry of Foreign Affairs filed a lawsuit against MBC for correction of information, saying, “MBC’s untrue reporting had a negative impact on domestic and foreign trust in our diplomacy.”

The first trial court ruled in favor of the Ministry of Foreign Affairs, ordering MBC to issue a corrected report stating that there was no ‘Biden’ remark.

At the time, the first trial court said, “Considering the time, place, background, context, and statement of former Foreign Minister Park Jin, who directly heard the remarks at the time, President Yoon used profanity and vulgar language toward the U.S. Congress and Biden. “It cannot be said that was used,” the ruling ruled.

Specifically, “President Yoon promised to contribute $100 million to the Global Fund, and President Biden referred to this as a ‘significant increase.’ If the opposition party does not agree to the contribution, trust in the Republic of Korea in the international community will decline. “There is enough concern that this could happen,” he explained, adding, “It is significant that he made a statement about this incident to the National Assembly of the Republic of Korea.”

After the sentencing at the time, MBC appealed against the first trial ruling, saying, “The Ministry of Foreign Affairs failed to properly prove that the MBC report was false during the trial,” and the appeal trial is currently in progress.
