Novo Futebol Clube, from Sidrolândia, was punished with the loss of nine points and a fine of R$ 1,000.00 for the irregular lineup of two athletes in two matches in the 2023 Sul-Mato-Grossense Série A Championship. applied in the first instance by the TJD-MS (Court of Sports Justice of Mato Grosso do Sul) is valid for the second phase (quarter-finals) of the competition.

With that, the first phase table, which defined the qualified for the quarterfinals and the relegated, remains unchanged. The decision was published on May 24 and the deadline to appeal to the Full Court (second instance) expires this Monday (29).

The main person interested in punishing Novo was Operário Caarapoense. The club from Caarapó was in group B of the competition and was relegated. If the Sidrolândia team was punished in the first phase, the relegated to the 2024 Series B would change.

Infraction – Novo irregularly used the athletes Lisandro Pires and Ferdinando Leda in the two games of the quarterfinals of the competition against Operário. The team won the first leg 2-0 at Estádio Sotero Zarate, in Sidrolândia, and lost 4-1 at Estádio Jacques da Luz, in Campo Grande. The sum of the scores disqualified the team.

The complaint was that the athletes were enrolled in the CBF (Brazilian Football Confederation) system after the deadline set in the State regulation. Novo’s defense even argued that the WEB/CBF Management presented an error, but the FFMS (Football Federation of Mato Grosso do Sul) reported that this is impossible.

The maximum punishment for this situation, provided for in the CBJD (Brazilian Sports Justice Code), is the loss of three points per game played plus the maximum number of points gained in the victory by regulation. As there were two games and the victory is worth three, nine points are reached.

The Judgment published by the TJD states that the Attorney General’s Office did not change the table of games played. It is also worth mentioning that the Federation published a document confirming the result of the Sul-Mato-Grossense Championship on the 2nd of May.

“Exotic Championship” – In the scores presented in the document, attention is drawn to the justification for the loss of points only in the second phase. “This year’s state championship is, to say the least, exotic,” said TJD-MS auditor Fernando da Silva.

The regulation provided that the teams with the best overall campaign decided the knockout clashes always at home and with a tie advantage. However, it is not possible to check the combined score of the campaigns on the Federation’s website. At each stage, the points were reset.

“The regulation clearly mentions points won, it is clear then that the championship is for points, and not a knockout dispute, however, even though it is for points, it is separated by phases”, explains Fernando.

This situation was also argued by Novo to avoid punishment in the first phase. That’s because the lineups happened in the second phase. Thus, sportingly, there was no change in the championship, as Novo was eliminated in the phase in question.
