LONG BEACH, Calif. (KABC) — The Los Angeles County District Attorney’s Office has charged suspect Miguel Avila with felony assault with the intent to commit a forcible sex crime and misdemeanor sexual battery after a backlash over the initial decision not to file charges.

The incident, which occurred on October 20th, involved Avila allegedly sexually assaulting a woman in downtown Long Beach. In the surveillance video, Avila can be seen approaching the woman from behind, unzipping his pants, exposing his genitals, lifting up her skirt, rubbing against her, and eventually pushing her to the ground.

The original decision by DA George Gascón’s office not to file a felony charge in the case drew criticism and prompted the Long Beach City Prosecutor’s Office to file a misdemeanor charge. However, after receiving additional evidence from the city, Gascón’s office decided to revisit the case and ultimately filed the felony charge.

“The pursuit of justice requires careful scrutiny and a commitment to upholding the safety of our community. In light of new evidence, we have taken decisive action to ensure that those who commit serious sex crimes are held accountable,” Gascón said. “I commend the victim for her bravery in coming forward. I want to emphasize that we will pursue this case with unwavering commitment. The accused will be held accountable for his actions.”

The victim, Rebekah Pederson, expressed her shock and disappointment with the initial decision not to file a felony case. Pederson believed that the video evidence alone should have been sufficient for charges to be filed.

“It’s mind blowing because nobody in their right mind thinks this is anything but attempted rape,” Pederson said. “Nobody in their right mind. Not one person.”

Avila was arrested in the area shortly after the incident took place. The DA’s office is now requesting bail of $150,000 for Avila.

The incident has sparked concerns about violence and safety in downtown Long Beach. City officials are looking to improve safety measures, especially near public transportation stops, to prevent similar incidents from occurring in the future.

Residents and businesses in the area have been on edge following a series of disturbing incidents, and the community is hopeful that the charges filed against Avila will serve as a deterrent and bring a sense of justice to the victim.
