This same Monday, March 25, the footballer’s defense made the payment of the million euros that the court requested as bail to grant him freedom.

After spending 14 months and 5 days in prison in total, the Brazilian soccer player Dani Alvessentenced to 4 and a half years for raping a woman in the bathrooms of the Sutton reservation in December 2022, has already crossed the door of the Penitentiary Center of Brians 2 after the court granted him the provisional release on bail.

The footballer’s defense made the payment of one million euros that the Provincial Court of Barcelona required to grant provisional freedom to Alves until the sentence is final. After that, all that was left was to wait for both his lawyers and the Court officials to carry out the pertinent procedures so that the Brazilian could leave Brians 2 this Monday. And so it has been.

Alves, who entered prison preventively on January 20, 2023 when the judge considered that there was risk of flighthas also handed in his two passports, the Spanish and the Brazilian, will have to attend the Provincial Court of Barcelona in person weekly and must respect a 1km restraining order regarding the victim.

Three days of trial and a sentence that did not satisfy any of the parties

After spending more than a year in the Brians 2 center, the footballer left his cell to go to the judgment held last February in section 21 of the Provincial Court of Barcelona. After three days of trial, and after just over 10 days of waiting, the court made public the judgment. The magistrates imposed a sentence of 4 years and 6 months on the footballer – almost the minimum – considering that yes there was sexual assault with carnal access. The pain, yes, was very far from the 9 years what the Prosecutor’s Office requested, and even more so from the 12 which the victim’s defense claimed.

Members of the personal de Sutton -scene of the events-, the friends who accompanied Alves to the nightclub, the two girls who were with the victim that same night and members of both the Mossos d’Esquadra, who treated the woman at the premises, as well as several doctors and forensic psychologists. In addition, both Alves himself and the victim gave statements before the court. The complainant, yes, did it behind closed doorshis voice was distorted and he gave his version behind a screen to protect his identity.

The sentence imposed by the court did not satisfy either party. The footballer’s lawyer, Inés Guardiola, already publicly announced that they would file an appeal to request provisional release. Taking into account the sentence imposed, and alleging that Alves had no intention of escaping and had shown a willingness to collaborate with justice, the defense’s hope was to cling to this concession from the judges.

Last Wednesday, the court made public an order by which the footballer was granted provisional release on bail. Two of the three judges voted in favor of this measure considering that, although the risk of flight had not disappearedit had been reduced enough to provisionally let Alves out until the sentence is final.
