The public prosecutor of Nanterre, Pascal Prache, announced this Thursday during a press briefing that he had opened a judicial investigation for intentional homicide, to shed full light on the circumstances of the death of young Nahel, shot dead on Tuesday by a police officer. during a traffic check in Nanterre. At the end of his police custody, Florian M., the police officer who shot the 17-year-old teenager, was brought before the two magistrates responsible for investigating the case, with a view to his indictment. “In the state of the investigations, the prosecution considers that the legal conditions for the use of the weapon are not met”, explained Pascal Prache. “In view of the facts, the need to preserve the investigations”, the prosecution requested his placement in pre-trial detention, added the prosecutor.

Facts

The prosecutor clarified the facts. After taking up duty on Tuesday, two motorcyclists from the Directorate of Public Order and Traffic (DOPC) noticed, around 7:55 a.m., that a yellow Mercedes Class A, “registered with Polish plates”, was driving on a lane bus “at high speed”, in the direction of the Nanterre University district. “In view of the behavior and the apparent young age of the occupants”, the agents “attempted for the first time to carry out a check”. Stopped at a red light, the vehicle “restarted by toasting the fire”. A chase then began, during which the yellow car committed, according to the investigation, “several violations of the Highway Code, in particular crossing pedestrian crossings endangering a pedestrian and a cyclist”.

Then, the vehicle driven by Nahel was stopped by a traffic jam. “The bikers dismounted”, before shouting to the driver to stop, positioning themselves on the left side of the vehicle, one “at the level of the driver’s door”, the other “near the wing front left “. There, the police “both took out their weapons”, which they “pointed at the driver to dissuade him from restarting”. As the car moved forward again, the policeman near the wing fired “once”. The vehicle then became embedded further in street furniture.

What the police said

During his hearings, during his police custody for intentional homicide, the policeman who admitted having shot explained his gesture “by the desire to avoid a new escape from the vehicle”, by “the dangerousness of the driving behavior of the driver “, inducing in him “the fear that someone will be knocked down”, the “fear of being hit” and of seeing his colleague, “further forward in the passenger compartment of the vehicle”, injured. Just like the second motorcyclist, heard under the free hearing regime, he “felt threatened when he saw the driver restarting, being near a wall”.

As Le Parisien revealed on Wednesday, the two bikers were confronted, “in particular on the comments made during the control and with regard to the amateur videos broadcast on social networks”. “Only part of the remarks were recognized by one of the officials. The technical investigations on these recordings have been entrusted to the IRCGN, in order to specify their content and their author,” said Pascal Prache.

Nahel was “known to justice”

According to the autopsy, performed on Wednesday, Nahel was killed by a “single shot” which “crossed the left arm and the thorax from left to right”. “Additional examinations, particularly in terms of toxicology, have been ordered”.

At the age of 17, Nahel was already “known to the courts” for acts of refusal to comply, “the last having given rise to a presentation of the minor to the Nanterre prosecutor’s office, Sunday June 25, with a view to a summons before the juvenile court in September 2024.

The search of the vehicle did not reveal any dangerous objects or narcotics. Screening operations, alcohol and narcotics, “proved negative”. The custody of the second passenger was lifted. The third person is always wanted.

The violence is “particularly serious”

“Regarding the events of last night, several damages to public utility goods were committed (…). The prosecution has been fully mobilized on this crisis since its origin, ”said the prosecutor. In Hauts-de-Seine, 27 people were taken into police custody on the night of June 27 to 28, and 39 for last night, for acts of “participation in gatherings, damage and violence”, ” facts of particular gravity”. This Thursday, 11 people were referred, including 3 immediate appearances, “in particular for people who have broadcast videos of police officers or the contact details of the police officer in question on social networks”.
