Were the data on Yvan Colonna’s attacker voluntarily erased? The Tarascon prosecutor’s office opened a preliminary investigation on Friday after the report of two Corsican deputies who noted a “major malfunction” and a “possible voluntary erasure of data” on Yvan Colonna’s attacker, we learned from of the prosecutor.

Entrusted to the judicial police of Marseille, this investigation was opened in particular for deletion of computer data in an automated processing system implemented by the State, explained to AFP the public prosecutor of Tarascon, Laurent Gumbau.

MPs Jean-Félix Acquaviva (Liot) and Laurent Marcangeli (Horizons), president and rapporteur of the parliamentary commission of inquiry into the fatal attack on the independence activist in prison in 2022, had written to the prosecutor in a letter dated July 5 under Article 40 of the Code of Criminal Procedure in the face of “the existence of facts which may, according to them, constitute an offence”.

Facts of non-assistance to person in danger

As part of the work of the commission of inquiry, a supervisor of the Arles remand center (Bouches-du-Rhône), where the attack took place, indicated on several occasions that she had “reported in the software Genesis (data processing on detainees, editor’s note) important facts “, in particular a “change of attitude” of Franck Elong Abé, the detainee who fatally attacked Yvan Colonna on March 2, continues their mail.

“However, we were able to observe that these observations do not appear in the Genesis monitoring software, nor in the additional tab transmitted by the management of the prison administration”, write the elected officials.

“If these actions were to be verified following the investigations carried out under your authority, it is also our responsibility to report to you the facts of non-assistance to a person in danger which led to the death of Mr. Yvan Colonna”, they add.

In its report published in May, the commission of inquiry into the fatal attack on the independence activist convicted of the assassination of the prefect Érignac had pointed to “serious shortcomings” in the assessment of the dangerousness of Franck Elong Abé, a “rigor » excessive with regard to Yvan Colonna, and « dysfunctions » of a general nature.
