The Democratic Center has formalized its claim of unconstitutionality against Law 2381 of July 16, 2024, known as the Pension Reform.

In a statement, the party expressed its discontent to the Constitutional Court, arguing that the approval of the law in the House of Representatives was carried out irresponsibly and without due debate by the opposition.

«This reform, approved without adequate deliberation, will irreparably damage the pension system of millions of Colombians and put the country’s fiscal sustainability at risk.“, the Democratic Center said.

The lawsuit focuses on procedural flaws during the approval of the law, especially in Article 84, which addresses tax provisions on pensions. According to Congressman Christian Garcés of Valle del Cauca, Law 2381 establishes a comprehensive social protection system for old age, disability and death of common origin, but contains problematic elements.

On his X account, Garcés announced that he had filed a lawsuit with the Constitutional Court against the reform promoted by the government of Gustavo Petro, according to the regional media outlet El País. Garcés is requesting that the law, or at least Article 84, be declared unconstitutional.

This article is crucial, as it establishes the bases for the social protection system and has important tax implications. Garcés considers that the article presents legal problems and has requested a conditional constitutionality of the same. He proposes that the 1000 UVT (Tax Value Unit) mentioned in the norm be considered monthly instead of annual, in line with article 206 of the Tax Statute.

The decision is now in the hands of the Constitutional Court, which will have to evaluate the arguments presented.
