The group of deputies and senators that defends the arming of the civilian population is trying to reverse measures adopted by the Luiz Inácio Lula da Silva (PT) government that restrict or modify access to firearms. The topic is discussed in at least two draft legislative decrees that revoke measures taken by the President of the Republic.

The requirement for an electronic record of equipment in the National Weapons System, of the Federal Police, is one of the points questioned. The measure gives 60 days to owners of weapons acquired after Federal Decree 9,785, signed by then President Jair Bolsonaro (PL) on May 7, 2019, to enter data into the system.

The ex-president’s decree relaxed the rules for registering, possessing, carrying and selling guns and ammunition to hunters, shooters and collectors (CACs). Lula set April 3 as the deadline for registration, leaving the owner subject to having the weapon seized and being investigated for committing a crime in case of non-compliance.

Deputy Alberto Fraga (PL-DF) claims that Lula’s decree is illegal. He explains that registrations should only be made with the Army, according to the law. By conditioning the sending of information to the Federal Police, the norm would be contrary to this legal provision. “The law cannot be changed by decree, that is what the law provides. The decree is to regulate the law and not to modify it. We are discussing that,” he said.

Alberto Fraga and other deputies linked to public security met with the mayor, Arthur Lira (PP-AL), to discuss the matter. The front wants space to discuss Lula’s measures in the House and is also looking for ways to reverse the “revocation” promoted by the government on the subject.

“We understand that it is necessary to have discipline and control, but not promoting this marginalization against the CACs. The market is suffering with this stoppage. A lot of people closing their doors, unemployment will come”, added Fraga.

The revocations come up against, for example, the service of armoring cars in the country, which was regulated in the context of the sale and authorization for the possession and carrying of firearms. Without the norm, sector entities report that companies have paralyzed activities in order not to commit irregularities.

Senator Hamilton Mourão (Republicanos-RS) said that the current government’s decisions regarding weapons are ideological and promised to tackle any disproportionalities. “These proposals of the current government are normally centered on an ideology, because the issue of CACs is not a problem that exacerbates violence in Brazil. Violence is exacerbated by the marginality that walks around and carries weapons in every possible way”, he declared.

According to the former vice-president of the Republic, the matter is already being discussed by a group in the Senate. “We are going to take the matter up within the Public Security Commission,” he said.

Shortly after the repeals promoted by Lula, Senator Marcos do Val (Podemos-ES) filed a draft legislative decree to overturn the decision that hinders access to weapons and ammunition. According to the parliamentarian, the text “contradicts the spirit of Law No. 10,826, of December 22, 2003, which gives citizens the right to acquire firearms, as long as the legal requirements are met.”

“The presidential decree is a clear restriction of economic freedom, directly impacting the economic activity legally carried out by millions of people, including merchants, instructors, manufacturers, in addition to a whole network of derivative services”, justifies do Val.

Senator Luis Carlos Heinze (PP-RS) also filed a draft legislative decree with the same intention. Both proposals are awaiting a vote.
