The Labor Electronic Domicile is the new official, mandatory and exclusive tool for communication and digital services of the Labor Inspection Service, that is, labor inspection under the responsibility of the Ministry of Labor and Employment.

The DET was established by article 628-A of the CLT and applies to all those subject to labor inspection, whether or not they have employees.

Companies have until May 1st to join the Electronic Labor Domicile (DET).

GOAL

DET is intended, among other purposes:

– inform the employer of any administrative acts, tax procedures, subpoenas, notifications, decisions made in administrative litigation and notices in general;

– allow the sending, by the employer, of electronic documentation in digital format required due to the initiation of an administrative procedure or inspection measure, as well as, in integration with electronic process systems, allow the presentation of defense and appeals within the scope of these processes;

– enable, free of charge, the issuance of certificates, including those related to administrative labor infractions, FGTS debts, and compliance with obligations related to labor legislation;

– provide free and interactive tools for preparing labor self-diagnosis and assessing risks in terms of safety and health at work;

– provide consultation on labor legislation;

– simplify payment procedures for administrative fines and labor obligations;

ATTENTION!

The tool is mandatory and applies to all employers, including domestic employers, and other entities subject to labor inspection, with or without employees.

Access to DET will be carried out through authentication through the gov.br account, with silver and gold security levels (det.sit.trabalho.gov.br).

The performance of acts in the DET may be carried out by third parties, using an electronic power of attorney granted by the employer.

The employer must provide and update at least one email address to receive automatic messages with alerts, informing the existence of communications to be received through the DET mailbox.

The company will be considered aware of the communication delivered by the MTE to the DET mailbox on the day the electronic consultation is carried out or, automatically, after a period of 15 calendar days when there is no consultation;

Communications will be made through DET and do not require publication in the Official Gazette or sending by post.

History/Implementation Schedule

From 03/01/2024: to employers in groups 1 and 2 of eSocial;

From 05/01/2024: to employers in groups 3 and 4 of eSocial and domestic employers.

Registration update

All employers and other entities subject to labor inspection, whether or not they have employees, must update their registration data with the DET, through the website https://det.sit.trabalho.gov.br

This registration update must be done before implementing the DET.

After updating the registration, the employer may grant a power of attorney to a third party to access the DET on their behalf, through the Electronic Power of Attorney System – SPE, available at https://spe.sistema.gov.br

Important

The employer must pay attention to the electronic mailbox to take the necessary measures in relation to each communication made by the MTE.
